Energi Motorhomes Barcelona information

The operator of  Energi Motorhomes Barcelona is a family owned business run from Barcelona in the beautiful Catalonia region of Spain. We do this because we love it and enjoy working on it everyday; we are not a large impersonal operation and we think this is what makes us unique.

Our aim is to make motorhome rental easy, fun and accessible to all so that you too can discover the joy of being 100% in control of your holiday and will want to rent a campervan again.

We hope to achieve this by drawing on our own experience of motorhome rental and campervan holidays over the years throughout Spain and all over the world in order to provide the quality of service we, ourselves would expect.

Energi Motorhomes Barcelona Rental Terms

Important information about your rental
On arrival you will be required to sign a rental agreement with the operators of Energi Motorhomes Barcelona. Here is a summary of their terms and conditions:

Definitions
The following definitions apply for the Terms and Conditions for the supplier.

-  The Supplier means the operator of Energi Motorhomes Barcelona.
-  The Client is also referred to as the hirer (s) or renter (s)

Payment
An initial non refundable booking deposit, as itemised in your booking breakdown of costs, will be required at time of booking confirmation. Accepted credit card payment for the initial deposit is Visa and Mastercard only. The remainder of the balance payable will be secured 45 days prior to the pickup of your vehicle. Accepted credit cards for this are Visa and Mastercard only.

Cancellation Policy
The initial deposit paid is non-refundable. The Balance Payable will be dealt with according to the number of days notice given, the following charges also apply:
 - +59 days prior to departure 100% refund except non refundable initial deposit
 - 45 - 59 days before scheduled departure: 50% refund
 - 31 - 44 days before scheduled departure: 25% refund
 - 3- 30 days before scheduled departure: No refund
 - No show – No refund.

Notification is the date used for calculating notice given and thus the amount of the cancellation penalty.
If, for unforeseen reasons the supplier are not able to provide a motorhome as booked we will fully reimburse the money received. Contact the supplier for more details about renting a motorhome in Spain.

Security Deposit
A 700€ damage deposit is required. If the motorhome is returned undamaged and in good condition, both inside and out, the deposit will be returned in full by bank transfer within 72 hours.

Driver Requirement
Drivers must be 23 years old or over and have had a valid driver's license for at least 3 years. A photocopy of all drivers’ licenses must be provided and the original shown before departure. Only those indicated as authorised drivers in this contract may drive the motorhome.

Kilometres
The daily rental rate for periods less than 1 week includes 200km free of charge (100km for rentals of less than 4 days). Extra mileage is charged at 0.25€/km and is payable on return of the motorhome. Rental periods of 1 week or more have unlimited mileage (unless otherwise stated on the rental invoice).
The supplier do have a special mileage 'pack': 500km for 100 € instead of 125€. Any number of packs can be purchased but they must be bought before departing in your motorhome.

Office Hours
Monday to Friday 9:00 - 1:00 and 3:00 -7:00.
Closed on weekends and public holidays.

Pick-up and Drop off Instructions
Motorhomes can be picked-up anytime between 9am and 8pm and must be dropped-off at the same time since we rent in 24 hour periods. The standard pick-up and drop-off time is 12pm unless you request otherwise. Please note that we are closed on Saturday afternoons and Sunday all day.

Pick up and Drop off
Unless otherwise stated on the rental invoice, the time of pick-up and drop-off is 12pm.

Late Returns
In case of late drop-offs, the supplier reserves the right to retain part or all of the 700€ deposit at the rate of 50€ per hour (or fraction of an hour) past the time specified on the rental invoice.

Rental Extensions
Extensions to the rental period must be agreed with the supplier no later than 48 hours prior to the scheduled drop-off.

Early Drop-offs and Late Pick-ups
No refund will be made for early drop-offs, late pick-ups or any unused portion of a rental period.

Hirer's Responsibility
The supplier accepts no responsibility for damage to or theft of/from vehicles left in supplier’s secure parking.

Insurance
The motorhome is fully insured for all drivers over the age of 23 with more than 3 years' driving experience. A deposit of 700€, payable on the day of pick-up (in cash) or by bank transfer at least 3 working days before the day of pick-up, is required to cover the Excess as well as any damage to the interior of the campervan or equipment.

The full amount will be returned within 1 week by bank transfer assuming the vehicle is returned undamaged and in good condition, both inside and out.

The rental price includes Fully Comprehensive insurance with an Excess of 700€. In case of damage to the motorhome the Excess will be covered the damage deposit. If the damage was caused by a third party the damage deposit will be retained until the Insurance Company of the third party covers the cost of the damage. The Insurance policy does not cover client’s luggage, goods or personal belongings. The Insurance policy includes roadside assistance (ARAG) which covers European Union countries, Switzerland and Andorra.

The motorhome may only be taken into European Union countries, Switzerland and Andorra.

The client will receive a copy of a ‘Damage Inspection’ report where they should record any existing damage they consider relevant.
Unless marked on the report it will be understood that the motorhome was received by the client in perfect working condition, with neither interior nor exterior damage and that any damage, breakages or mechanical issues during the rental period will therefore not entitle the client to any claim for compensation.

It is not permitted to carry more passengers than established by law, participate in races or competitions, transport or carry goods or belongings which may cause damage to the motorhome, allow third parties not included in this contract to drive or use the motorhome, assist in illegal acts, tow other vehicles, drive off-road, drive under the influence of drugs or alcohol or modify the structure of the motorhome.

Personal Travel Insurance
We strongly recommend that all people travelling in Spain take out Personal Travel Insurance.

Repair
In the case of repair work carried out during the rental period at the expense of the supplier, with a quotation in excess of 50€, permission must be obtained in advance from the supplier. The cost of repair work approved by the supplier will initially be paid by the client and later, once the rental period is completed, will be refunded by the supplier by bank transfer within 72 hours. Any replaced pieces must be kept in the motorhome and presented to the supplier together with the original invoice. All invoices must be made out to the supplier:

Any invoice without the previous details will not be reimbursed by supplier.

Responsibilities of the Client:
1. No Animals and No Smoking inside the motorhome.
2. Oil, tyres, lights, brakes, cooling system etc. must be monitored by the Renter. Any problems must be communicated to the supplier immediately… not on return of the vehicle.
3. In case of breakdown, damage or other problem with the motorhome, the Renter is obliged to do everything possible to solve the problem by themselves so that no damage or only minimized damage (physical or material) shall occur. Renters are responsible for reporting all damages and accidents to the supplier immediately… not on return of the vehicle.
4. Use of the motorhome is limited to sealed (paved) roads only.
5. Travel is limited to EU countries.

If any of these conditions are not met, a standard fixed charge of 50€ per infraction will apply, in addition to any costs the supplier may incur.

All fuel usage, gas canister refills, toilet chemical purchases, toll fees, campsite expenses, parking tickets, speeding fines etc. occurring during the rental period are at the clients expense.

The motorhome must be returned in accordance with the following:
1. The motorhomes’ 2 batteries should be at least 2/3 charged.
2. The interior should be clean and tidy.
3. The exterior should be sufficiently clean to allow for a damage inspection.
4. Bed linen and dish towels must be stripped and placed in the main cupboard.

If any of these conditions are not met, a standard fixed charge of 10€ per infraction will apply, in addition to any costs the supplier may incur.

5. The fuel tank must be returned full.
6. The motorhome is supplied with 2 gas canisters. The canister which is not in use must be returned full… the sealed plastic cap must be intact.

If this condition is not met, a standard fixed charge of 15€ will apply, in addition to any costs the supplier may incur.

7. The Black and Grey water tanks must be empty. In the case of the Black water tank, there must be no toilet paper or residues.
8. Damage (interior or exterior) must be declared… however seemingly trivial it may be.
9. Parking tickets or traffic violations must be declared and paid.

If any of these conditions are not met, a standard fixed charge of 50€ per infraction will apply, in addition to any costs the supplier may incur.

FAQ

Q: Where can I pick-up/drop-off a motorhome?
A: At our base in Manresa or at either Barcelona or Girona airport. Please note that additional fees apply for our airport service.

Q: Can I pick-up/drop-off a motorhome in Madrid, Valencia, Bilboa, Malaga etc.?
A: Not at this time

Q: What is the minimum age?
A: 23 with a driving licence for a minimum of 2 years.

Q: What documentation do I need to provide?
A: Photocopy of driving license for all drivers.

Q: Can we take our pet?
A: No. We have a strict rule that no animals are allowed inside the vehicles. This is out of consideration for other renters who may not react well to animal hairs and also to minimize the likelihood of damage to the interior of the vehicle.

Q: Is smoking allowed?
A: No. Same reason as above. Other renters may not appreciate the smell of cigarettes.

Q: Does the motorhome have a power supply? (12V vs 240V)
A: Yes, the motorhome does have an independent power supply but it is important to understand that while you are on the move (not hooked up to mains electricity at a camp site) you are limited to the use of 12V products which run off of the motorhome's battery. You can purchase 12V products such as kettles or hair-dryers but standard household products will not work.

If you are hooked up to mains electricity at a camp site you are able to use 240V equipment without any problem. Motorhomes typically have at least 2 plugs.

If you need to be able to use 240V products without being hooked up to mains electricity you can use a power converter (12V - 240V) but this does have it's own limitation... you will need to have the motorhome engine running.

Q: Are seatbelts compulsory?
A: Yes. Front and back. Adults and children. And baby chairs for babies is compulsory under Spanish law.

Q: How long do gas bottles last?
A: There is no guaranteed answer to this question since it depends very much on number of occupants, season, usage etc. As a rough guide it would be reasonable to expect 1 bottle to last 1 week under normal conditions. Since the motorhomes come with 2 gas bottles (at least 1 at 100% full on pick-up) running out of gas should not be an issue for rentals of less than 1 week.

Q: Where can I buy replacement gas bottles?
A: In Spain you can buy Butane and/or Propane gas bottles from most Repsol Service Stations or 'Official Service' centers.

Unfortunately there is no standardisation of bottled gas across Europe. If you will be travelling outside Spain you should bear in mind that other EU countries may not use the same system (bottle and connector) and you may need to buy a new bottle and the adequate connector.

If you would like to avoid running out of emergency supplier can provide a Camping Gaz 907 2.72kg Refill plus connector (20€) which can be used and sourced across Europe. Please note however that these are small bottles and will not last as long.

Do I need Butane or Propane?
Butane, usually in blue bottles, is heavier than Propane, and more energy can be stored in a given bottle size. Propane, although lighter than Butane, has the advantage of remaining usable under freezing conditions and is therefore the best choice for winter motorcaravanning. Butane stops working as the temperature falls towards 0° C whereas Propane works well at very low temperatures indeed (down to about minus 40°C !). Since Propane also works OK at normal temperatures many motorcaravanners like us use Propane all year round.

Q: Can we take the motorhome outside of Spain?
A: Yes. But please let us know at the time of booking which countries you will be going to. The only limitation is that you cannot take the motorhome outside of the EU.

Q: Can we park anywhere?
A: Yes... using your common sense. Any vehicle which weighs less than 3.5 tonnes is considered a passenger vehicle. This means that our motorhomes are considered equal to cars and can park anywhere a car can.

The real problem though is not parking but camping, so....

A motorhome is considered to be parked when:

1. It is only in contact with the ground through the wheels (no stabilizers or levellers are being used).
2. It does not occupy more space than it would when closed... in other words there are no windows open (please be careful about that one!), seats or tables out, awning extended etc.
3. No fluids have been expelled except those due to the combustion of the engine through the exhaust... in other words, no grey or dirty water has been dumped.

If any one of these rules is broken, the motorhome is camped and that is illegal.

Q: Is the motorhome fully insured?
A: Yes. All our vehicles are fully insured with the exception of the first 700€ which is why supplier ask for a Security Deposit.

Q: What do we do if we are broken into?
A: Although infrequent this does happen. First check what has been stolen from your personal belongings (for your own travel insurance claim) and what has been damaged or stolen from the vehicle so that you can get a Police statement. Contact the operating staff of Energi Motorhomes Barcelona for further instruction during open hours for further instructions.

Q: What do we do if we break down?
A: As part of our insurance policy, each motorhome has 24 hour break down cover across Europe. Details are in the motorhome.

We welcome feedback from our customers on their experience with our suppliers. We may, at our discretion, provide you with reasonable assistance in resolving any dispute you may have with a supplier.

Our total liability to you in relation to your use of this website and the information contained on this website will not exceed the dollar amount of the deposit we have received from you in relation to your booking/rental. Refunds will not be made for bookings cancelled due to inclement weather. Again, we strongly recommend that you take out travel insurance. Your use of this website is governed by the laws of New Zealand and the jurisdiction of the New Zealand courts.

Booking information
To make a booking you must complete our booking form which is easy to follow and secured with the latest encryption technology. Once we receive your form, we will, subject to availability, confirm your booking by emailing you a confirmation voucher and invoice. The deposit required to secure your vehicle (as shown on the secure booking page) will only be processed on your credit card when your booking is confirmed. Please note that a 1.75% credit card charge will be added when your payment is processed.

A booking is confirmed when you have been emailed a confirmation voucher and at this stage the deposit is processed on your card and becomes non-refundable and any cancellation fees stated in the supplier's terms apply. Upon receipt of your confirmation, please check your details carefully and notify us immediately if there are any incorrect details, as it may not be possible to make changes at a later date.

If you are booking via phone, please make sure you have read the terms and conditions of the vehicle you wish to rent first. Our reservations consultant will ask you if you have read the terms and agree to them before proceeding. The onus is always on the renter to ensure they make themselves fully aware of the terms displayed on our website.

Information disclosure
In booking on this website you acknowledge that we disclose your information to your selected Supplier in order to provide the requested rental services.

Amendments
Please note that some suppliers treat an amendment as a new booking and apply the rate current at the time the amendment is made to recalculate the entire booking amount (not just the days changed). If the rental period is increased, an additional deposit may be required. If the rental period is shortened which results in a reduction of the rental charges, the deposit amount will remain unchanged, and the difference between the original and revised deposit is forfeited (it cannot be used towards remaining rental charges). To request a change to a confirmed booking, please use the alterations request link on your confirmation. Any alterations are subject to availability and the approval of the supplier. In addition to the alteration policy of the supplier stated in their terms, the following charges will apply:
Motorhome rental alterations (all charges stated in local currency):
To change dates or times that result in a recalculation of rental rates, or to change vehicles or locations: 75.00
To add or remove extras to/from confirmed booking: 20.00
The alteration fee will not be charged if your alteration request is not possible.

Vehicle Capacity and fitness to drive
Under no circumstances are you permitted to carry more passengers than the vehicle you rent is legally registered to carry, and if you do your insurance may be invalidated. The number of seatbelts (and passengers) is indicated next to each vehicle on this website. Luggage capacity where shown is an indication only and we will not be responsible should you be unable to fit your entire luggage into a vehicle. It is your responsibility to choose a journey that is within your capabilities. A vehicle supplier can refuse to rent a vehicle to any person who is in their opinion unfit to drive or does not meet eligibility requirements. In such circumstances we will have no further liability to you.

Refund Policy
We are committed to providing a quality service and aim for complete customer satisfaction. In the event of cancellation, any refunds or penalties are detailed in the terms and conditions of your selected vehicle that you are asked to read and accept at time of booking. In the event you are unsatisfied with our service, please contact us within 48 hours of placing your booking or request and we will work to resolve any issues and determine if compensation is due. In the event you have completed your rental and are unhappy with your vehicle, we are happy to assist you in seeking compensation from the operator of the vehicle.

Flamenco Campers Rental Terms

Important Information About Your Rentals

On arrival you will be required to sign a rental agreement with the operators of Flamenco Campers. Here is a summary of their terms and conditions.

Definitions

The following definitions apply for the Terms and Conditions for the campers.
  • The Supplier means the operator of Flamenco Campers / FC Company / (lesser).
  • The Client is also referred to as the hirer (s) / renter (s) / (lessee).
Please read these terms and conditions since they are compulsory.

Payment terms

A non refundable booking deposit is required to secure your motorhome booking. The exact amount is detailed in the breakdown of pricing.
A second stage payment of 40% is taken shortly after booking confirmation as a separate transaction. The remaining balance is due in full, 30 days before the commencement of hire. 
Paypal / credit card payment will have an extra cost of 3,6% / 1,1% on the rental price, for bank charges. Payment with American Express card will have an extra charge of 5% on the rental price. FC will only accept credit card payments, bank transfer or cash. All payments made by customers and money returns by FC will be made in EURO (€).

Rental Terms & General Conditions

1. Scope, contents of the contract and applicable law

1.1.The following Rental Terms & General Conditions of the company FC are the only applicable ones. Any conditions from the client that may be different or contrary to the Terms and Conditions of the company FC will not be accepted. These shall be also valid when the company FC hires a camper without a prior reservation, even knowing the differing conditions from the customer.

1.2.The contract signed with the client only entails the delivery of the camper under rental conditions and, if previously agreed, of extra or optional accessories offered by FC and reserved by the customer in advance.

1.3.A rental agreement shall be signed by the Client and the Company FC when the vehicle is delivered, which shall be  governed solely by Spanish laws, by the general conditions set forth in this contract and by the special terms agreed between the parties. The Customer will organize his/her trip and shall use the vehicle under his/her own responsibility. The rental contract is limited to the period agreed by the parties, excluding any unspoken extension of said contract for an indefinite period of time due to continued use.

1.4.All agreements between the company and the customer FC shall be in writing, whether by electronic mail or post  or personally.

2. Minimum age and authorized drivers

2.1.The Client’s age, and of any authorized driver (maximum 2 drivers) shall be at least 28. The driver shall have a Driver’s License Class B in force,  for more than three years, or the equivalent License of his/her country of origin. If you do not live in the EU you must have an international Driver’s Licence for these vehicles. The client shall pay an additional amount for every additional driver, which is established in the price list of FC in force at the time of booking.

2.2. If at the time of delivery of the camper by FC, the Client does not have the appropriate Driver's License for vehicle rented,  or if the document is false or inaccurate, it shall  be considered for all purposes that the Client has failed to collect the camper, and therefore the  conditions of cancellation of the  Client’s binding reservation shall become immediately applicable  according to item 4.2 hereto, and the Client shall not have the right to any compensation or reimbursement whatsoever.

2.3. Only the Client and the driver’s included in the rental contract may drive the vehicle, and they shall fulfill the conditions set forth in paragraph 2.1 hereto. At the time of booking the vehicle, the driver or drivers are obliged to send to FC copies of the following documents:

a) Identification Card or Passport.
b) European Driver’s License or International Driver’s License.
c) Credit card valid for the next 6 months from the date of hire.
d) Invoice or bill (2 months max.) of domestic supply (telephone, water, electricity, bank, etc ...) to confirm your address.

At the time of picking up the vehicle you must present all original documents. All authorized drivers will be personally responsible for any legal infringement in which they incur during the rental period. The Client expressly authorizes FC to charge to his/her credit card the economic consequences of any violation committed during the rental period during the following twelve months.

3. Prices and length of rental

3.1.The rental price of the camper and the minimum rental period during the different seasons of the year are the ones listed in price list in force of FC company at the time of booking. Depending on the rental days reserved, the prices that appear in the list for the appropriate season shall be valid. For each rental, a fixed and sole amount will be charged for services rendered. An extra amount will be charged for mileage excess, if applicable. This extra amount can be checked in the FC Price List in force at the time of reservation or when the contract is signed, the client expressly declaring that he/she is informed and accepts.

3.2.The rental prices for optional accessories are included in the valid price list of the company FC at the time of booking and the Client expressly acknowledges and accepts them.

3.3.The minimum rental period is three (3) days and the maximum is forty-five (45) days.

3.4.The rental prices include 18% VAT, unlimited mileage for more than seven (+7) days of rental, fully comprehensive insurance under insurance coverage (see below Art. 11) and roadside assistance in case of failure.For shorter periods, a maximum distance allowed is 200 km per day at a cost of € 0.40 per km + VAT in excess.

3.5.The rental period begins when the Client collects the campervan at the rental center at the time agreed with FC, and ends when the campervan is delivered by the customer at the same rental center at the time agreed with FC.

3.6.If the campervan is returned after the agreed time, the customer shall pay FC the amount of 60 € + VAT for every hour of delay. However, the maximum charge per day of delay is 480 € + VAT. The client is responsible for all costs due to the delay in delivering the vehicle and especially for those expenses derived from the fact that another client or another person to assert their rights against FC as consequence of this delay.

3.7.in case of returning the vehicle before the expiry date of the rental contract, the Client is obliged to pay the full price agreed in the contract, and FC shall not be obliged to reimburse any amount.

3.8.The campervan will have the fuel tank full and should be returned the same. If not, FC will charge the customer the amount of the fuel necessary to fill the tank increased by 100% for management fees. All fuel and maintenance expenses during the rental period will be at the customers charge. The fuel used is only DIESEL (It is expressly prohibited to use Biodiesel, therefore the client shall be responsible for all expenses caused as a result of using a fuel other than diesel.

3.9.To return the vehicle in a different location than that of collection, a special agreement with FC is required: The price of this service will be agreed before collecting the campervan.

4. Booking and cancellation

4.1.Reservations shall only be binding after confirmation from FC and the second stage payment of the EUR 40% deposit by the Client depending on 4.2., and exclusively for a category of vehicles, not for brands or models of vehicles. This is also valid even if the description of vehicle category is indicated by way of example in a particular model.

FC is obliged to provide a vehicle of the selected category. In the event that the vehicle reserved is not available due to “force majeure” circumstances, FC reserves the right to substitute an alternative vehicle without prior notice. The alternative vehicle will be as similar as possible to the one originally booked. FC will reasonably determine if it should indemnify the Client and the amount, if the vehicle has to be replaced.

4.2.Cancellation
The initial deposit paid is non-refundable. Upon confirmation that your selected vehicle is available a non refundable second stage payment of EUR 40% will be taken from your nominated credit card. In addition to forfeiting your deposit, the following charges also apply:
  • Up to 53 days before the starting rental period, 20% of the total rental price.
  • Between 28 and 52 days before the starting rental period, 50% of the total rental price.
  • Between 19 and 27 days before the starting rental period, 75% of the total rental price.
  • Between 18 and 11 days before the starting rental period, 90% of the total rental price.
  • Less than 10 days before the starting rental period, 100% of the total rental price.

4.3.You can change the date of rental once. In order to be valid, said change shall be notified at least 25 days in advance. The client shall inform of the new date chosen when informing of said change, and this new date must be within the following 12 months starting from the first day of the original lease. This service carries a surcharge of 20% of your rental, always with a minimum fee of 100 €.

5. Deposit and guarantee

5.1.At collecting the vehicle, the client shall pay SIX HUNDRED EUROS (600 €) with a valid credit card as deposit and guarantee of the faithful compliance of the contract obligations. Before FC delivers the vehicle to the Client, both parties shall sign the vehicle rental contract, which will include all special conditions of the valid binding reservation agreed and in accordance with the general conditions of rental hereto, which shall be expressly accepted by the Client as part of the contract. Non-acceptance of the general conditions by the Client at such moment shall be considered as the cancellation of the binding reservation, and paragraph 4.2 hereto shall be applied.

5.2.The deposit shall be refunded no sooner than forty-eight (48) working hours after the vehicle has been returned, and after the vehicle has been examined by a responsible person of the Company, who in case of damage due to misuse or lacking any item included in the inventory, shall inform of the amount to be paid by the Client. This amount will be deducted from the Client’s deposit, and the Client shall pay for the difference if the cost of the damage exceeds the amount of the deposit. In case it is not possible to assess the damages immediately, FC has 60 days to settle and refund the deposit, if appropriate, or claim the difference of this deposit and the cost of the damages. In case of an accident, the amount of the insurance franchise will also be deducted from the deposit. In case FC has to pay the Client a compensation of the amount of the rent paid in advance, said amount shall be returned together with the deposit.

5.3.The deposit shall be used to cover the cost of any loss or damage of equipment, complements, extras, and repair of negligent damages in the vehicle.

5.4.The customer has expressly agreed to pay to FC:

a.Upon returning the vehicle:  the amount of exceeded  mileage, if appropriate, in rentals between three (3) to seven (7) days, calculated at the rate in force and / or additional charges arising from the application of these Terms and Conditions of Rental.
b. Additional charges that may arise if the vehicle is returned elsewhere, without FC’s permission.
c. The amount of any type of penalties, fines, judicial and extrajudicial expenses arising from any traffic violation, whether administrative, criminal or any other kind, which are directed against vehicle, the client or FC, during the rental period, unless it is due to FC’s fault.
d. In the event that the vehicle is retained, blocked, sealed, deposited or seized, or otherwise immobilized by any reason due to customer’s fault, all expenses will be on the account of the Client, including the company profit loss on leasing during the term of the vehicle’s detention.
e. Expenses incurred by FC (including Lawyers and attorneys' fees, even though their intervention was not mandatory) in claiming the amounts owed by the client under this contract.
f. The vehicle has a comprehensive insurance with franchise (excluding the customer's and
companions personal effects). In case of accident or theft, the customer shall pay the amount of € 600 for the claim.
g. All damages caused to a third party or to FC not covered by the insurance of the vehicle, and assessed economically at that time, subjected to paragraph 5.4.

5.5.If the customer delays payments, late payment interests shall apply in accordance with the  legislation in force.

6. Delivery and return of the vehicle

6.1.Before the trip, the client shall follow the instructions given by FC’s staff at the point of delivery. A document of delivery (Check Out) will be issued, describing the conditions of the vehicle and the inventory on board that shall be signed by both parties. FC may deny delivering the vehicle until the operation instructions of the vehicle have been totally given.

6.2.When returning the vehicle, the Client shall undertake a final inspection of the campervan with an FC employee. At the Return (Check In), a Document of Return will be issued, which must be signed by FC and the Client. Damages not included in this Document of Return, but detected while returning the vehicle shall be charged to the customer and will be deducted from the deposit.

6.3.Generally the vehicles delivery will be from Monday to Friday, from 2:00pm to 7:00 pm; the returns shall be done from Monday to Friday before 11:00 AM. The timing showed on the rental contract shall be considered as agreed. On Saturdays and Sundays, deliveries and returns will only be accepted if it has been agreed previously and an additional cost will be charged in accordance with rates in force. The day of delivery and return will be considered, joined together, as one day, provided that the total does not exceed 24 hours or only if they are exceeded due to causes attributable to FC.

6.4.Non authorized delays in returning the vehicle shall be punishable under item 3.6. If the reason of the delay in returning the vehicle  is caused by Force Majeure, it shall be reported immediately to FC to be accepted; If not, it will be considered a non authorized delay.

6.5.If the Client wishes to extend the lease, he/she shall ask FC at least three days before the contract expires.  The eventual confirmation of the extension shall be subject to availability at the time given. Therefore FC shall not assume any kind of previous commitment.

6.6.Any changes of the hire dates shall be previously authorized by FC. Breach of this condition entitles the company FC to recover the vehicle or to request it in Court. FC shall have the right at all times to request the return of the vehicle at any time during the term of the rental contract, if its use infringes the provisions set forth in the contract or in these general conditions.

6.7.If the vehicle is returned at the end of the rental period and the Client is not present when the vehicle is being checked due to reasons attributable to him/her, mail delivery or unavailability, and damages are observed in the vehicle, the Client accepts the appraisal of damages resulting from inspection by FC´s staff.

6.8. The vehicle shall be returned clean outside and inside, and with empty deposits of waste and toilet water. Otherwise there will be a surcharge of 150 € + VAT as cleaning fee, in accordance with FC’s rates established for this purpose.

6.9. Filling the clear water tank with diesel or any other fuel, or filling the diesel tank with water or other fuels (including biodiesel), means a penalty of 750 € + VAT.

IMPORTANT: Please note that after you return the vehicle, we have a period of time to prepare it for the next client. You wouldn’t like being the next customer, if it is returned late.

7. Prohibited uses, maintenance and protection obligations

7.1.The Client acknowledges receiving the vehicle in perfect mechanical conditions, equipped with the
necessary documents and tools, tires and accessories and he/she agrees to maintain it in good conditions. The Client also agrees to respect at all times the obligations and limitations described in the Circulation Code of Circulation in force, and agrees to the following:

a.To not allow others to drive the vehicle aside from himself/herself or the people specially authorized.
b. To take no more than the passengers specified in the vehicle documents (max. 4 pax.), or take in the camper any kind of pets without the permission of FC. In case of being authorized to take pets or animals the camper must be returned free of hairs and odor.
c. To not sublease or transport persons for commercial or other purposes not included in the contract.
d. To not carry any goods, drugs, toxic, flammable or explosive items nor lighting candles inside the vehicle.
e. To not transfer the use of the vehicle to third parties, either free or paid, and to not help criminals.
f. To not commit crimes, although these may be only punishable according to the legislation in force of the place where the crime took place.
g. To not drive the vehicle with a physical disadvantage due to alcohol, drugs, fatigue or disease, use of medication, etc.
h. To not drive outside of roads or any unsuitable terrain, or participate with the vehicle at sporting events, endurance racing or other events which can damage it.
i. To not use the vehicle to push or tow other vehicles or trailers.
j. To not unseal or manipulate the odometer. The client shall immediately notify any fault on it.
k. In order to drive in the countries listed bellow, the express authorization from FC shall be necessary. The customer must notify in advance he/she will be driving in any of these countries, in order to make an additional charge that covers the road assistance as well as an extension of the vehicle´s insurance. These countries are: Andorra, Austria, Belgium, Croatia, Czech Republic, Cyprus, Denmark, Estonia, Slovak Republic, Slovenia, Finland, France, Britain, Greece, Holland, Hungary, Iceland, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Norway, Poland, Portugal, Sweden and Switzerland. Driving outside these countries shall not be authorized under any circumstance.
l. It is expressly forbidden to travel to any country where there is war or an armed conflict.
m. To have the vehicle properly parked when not being used and protect it from damages caused by frost, hail or other atmospheric phenomenon capable of causing important damages.
n. It is expressly prohibited to vary any technical characteristic of the vehicle, keys, locks, equipment, tools and / or accessories, making any changes to the interior and/or exterior appearance, unless having express written permission from FC. In case of violation of this section, the tenant shall pay all costs of reconditioning the vehicle to its original state, paying as well a compensation for the time the vehicle can not be used until it is completely repaired. In case of losing the vehicle’s keys or documents, the client shall pay FC the amount of 180 € + VAT.

7.2.The vehicle must be treated carefully and closed properly. Technical standards and determinant provisions of use shall always be taken into account. The vehicle’s condition shall be monitored at every refueling, specially water and oil levels and tires’ pressure. The customer undertakes to check regularly if the hired camper is in perfect conditions to drive safely. If the vehicle is damaged as a result of overheating due to low oil or engine coolant, FC will not reimburse the Client the deposit paid as guarantee.

7.3.Smoking and lighting candles inside all the vehicles is prohibited. The client may take pets (only dogs) if FC has given express authorization and under their conditions. Cleaning costs resulting from any breach shallbe paid by the customer. The Client must also assume the costs of aeration and cigarette odor removal, including losses generated by the inability to rent the vehicle for some time due to this reason.

7.4.In case of finding out that any of the conditions under paragraphs 7.1., 7.2. and 7.3 have been breached, the company may immediately terminate the rental agreement and ask for the vehicle to be returned,  and the customer shall be obliged to pay the full rental and any expenses under those paragraphs.

8. Behavior in case of accident

8.1.In case of accident, theft, fire or damages caused by wild animals, the customer must immediately inform the police and FC by calling the rental center. Out of the Customer Hours Service or during holiday, the client shall notify the company the hour and day immediately after the mishap occurred. The Client is obligated to pay all damages as a consequence of failure or delay in notifying any of these eventualities to FC.

8.2.The responsibility for the fact will never be recognized or prejudice except for the “Friendly Accident Declaration”. The client shall obtain all the information of the other party and any witnesses that must be sent to FC within the deadline specified by the company. The client shall immediately notify the authorities of the accident if it is the fault of a third party. The accident report shall be submitted complete and signed, never after returning the vehicle to FC. The document shall also include the name, address and phone numbers of the people involved, information of their driver's license, the other party’s information together with the Insurance Company name and policy number, potential witnesses’ information, and plate numbers of the affected vehicles.

8.3.In case of robbery or theft of the vehicle, the Client shall immediately report it to the competent authority informing and sending FC within 24 hours a copy of the police report,  together with the  car keys. Otherwise, the insurance coverage contracted shall remain without effect.

8.4.Even in case of damages without third parties involved, regardless of their severity, the client shall write FC a Comprehensive report and draw a sketch. If the Client does not draft the report - no matter whatever the reason is- and this prevents the insurance company from paying damages, the Client will be required to pay the entire amount.

8.5.Do not leave the vehicle without taking adequate measures to protect and safeguard it. If necessary, contact the Road Assistance contracted with FC´s Insurance.

8.6.In case of default by the customer of any the above-mentioned measures, when applicable, FC can claim the Client the damages caused by his/her negligence, including loss of profit during the term of the the vehicle is immobilized.

9. Motor defects

9.1.Rights to compensation for Client damages are excluded due to defects not attributable to FC.

9.2.When returning the vehicle, the customer shall indicate any defect detected in the camper and/or its equipment during the rental period. Compensation rights are excluded for damages if defects are notified later, unless such claim is motivated by a non-obvious damage.

10. Vehicle repair or replacement

10.1.The Client assumes the normal mechanical wear of the vehicle. When the duration of trip or road conditions may advice so, the necessary maintenance operations shall be carried out in an official  service of the vehicle´s chassis-engine brand.

10.2.The Client is obliged to stop the vehicle as soon as possible when any indicating light turns on indicating an anomaly in the vehicle’s operation. The client shall contact FC or the Assistance Company arranged by FC and no other. The Client shall only use the official brand of the chassis-engine service, unless permission from FC.

10.3.The Client may carry out the necessary repairs to ensure safety during the operation of the vehicle during the rental period and that do not exceed 150 €. To do this, it FC approval shall be requested. FC will pay for the cost of repairs if the original invoices of the spare parts changed are provided, as long as it is not the client’s responsibility under item 11. Damages affecting tires, rims and car windows occurring during the term of lease are excluded, which are always and in any case under customer's responsibility. Any fault and repairs due to defects in the ground, pavement or asphalt are the responsibility of the customer. Provisions of Item 10.5 will be applied if the repair is over € 150.

10.4.If a repair of these characteristics is necessary for reasons attributable to FC and the Client does not undertake it, the Client shall inform FC immediately of said defect and allow a reasonable time to repair it.  FC is not responsible for the specific conditions of each country (eg. infrastructure), which may lead to a delay when making repairs.

10.5.In case of any malfunction of the vehicle or indoor elements, the Client shall notify FC immediately, which shall provide the appropriate instructions to repair it.

10.6.In the event of serious damages or breakdown of the camper, non being the client’s  fault, and it is foreseen that the vehicle will not be fixed in the next 48 hours, or that it can not circulate, and the client is within the territory of  Andalusia, FC will provide  the customer within 48 hours an equivalent or bigger (in the number of seats) replacement vehicle. The termination of the contract is excluded and therefore the Client must accept the new vehicle, and FC shall not be obliged to pay any compensation for the possible loss or damage caused to the Client.

10.7.In the event of serious damages to the campervan, being the client’s fault, and it is foreseen that the vehicle will not be used for a long period of time or if it must be withdrawn from circulation, FC may refuse to provide a replacement vehicle. In this case, the termination of the contract by the customer will be excluded, who will be obliged to pay the full price of the lease, plus costs that these actions may have caused. If FC decides to make available to the client a replacement vehicle, the Client will be charged with any costs arising there from.

11. Responsibility of the renter, all risk insurance

11.1.According to the terms of the comprehensive insurance, in the event of integral damages ,FC shall release the Customer from the responsibility of the material damages suffered by the vehicle, with an excess of SIX HUNDRED EUROS (600 €), which the customer should undertake.

11.2.The client, under no circumstances, shall be exempt of his/her civil, administrative, and criminal or any other kind of responsibility arising from an accident or from malicious or negligent behavior.

11.3.The grounds of exemption of liability provided for in paragraph 11.1, shall have no effect if the Client fails any of the rules indicated under clauses 7 and 8.

11.4.Exoneration of responsibility of Art. 11.1 shall not proceed if the client has willfully or negligently caused any damage.

11.5.Also, the customer shall respond in case of willful or negligent behavior in the following cases:

a.If the customer does not respect the driving rules and code of the country where it circulating.
b.If the damage is due to reckless driving under the effects of drugs or alcohol.
c. If the client or the driver, to whom FC has rented the vehicle, escapes in the event of an accident.
d. If the client, against the obligation established under Art. 8, does not report the police in case of an accident, except when such infringement has not influenced the verification of the reasons of damage or in the scope of that damage.
e. If the Client does not fulfill other obligations under Art. 8, except if such infringement has not influenced the verification of the reasons of damage or in the scope of that damage.
f. If the damage is due to a prohibited use under art.7.1.
g. If the damage is due to a breach of obligation under Art. 7.2.
h. If damages haves been caused by a non authorized driver, to whom the customer has left the vehicle.
i. If the damages have been caused by ignoring the vehicle’s dimensions (height, width, length).
j. If the damage is due to a breach of the rules related to additional load.

11.6.The customer is responsible for all costs, charges, fines and penalties related with the use of the vehicle to be claimed from FC, except whether to reasons attributable to it.

11.7.In the case of multiple clients and / or drivers all of them will respond as joint debtors.

11.8.International Insurance Extension (12 € per day ) applies to traveling out from Spain (Portugal, France).

12. Lessor's responsibility

12.1.FC delivers the vehicle in perfect condition, having made all the checks and maintenance necessary for its proper operation. FC will not be responsible for neither mechanical failures nor malfunctions on a normal use of it, nor from the expenses and damages that the Client may have to pay or damages suffered directly or indirectly as a result of such failures or faults.

12.2.If due to force majeure, fortuitous reasons no attributable to FC, the vehicle can not be  delivered on the agreed date, no compensation will be given to the Client, except for the reimbursement  by FC of the amounts  paid  to date in concept of rent.

12.3.FC assumes no responsibility over the customer´s vehicle parked, as free parking at the company premises or its environs, during the rental period of the motorhome.

12.4.FC will only respond to a limited extent to the foreseeable damages established in the contract, to the extent that they may violate an obligation of which compliance is important to achieve the object of the contract.

12.5.The "Rental Terms & General Conditions" bind both parties from the date of reservation onwards and they are an integral part of the vehicle leasing contract.

13. Protection of personal data

For the purposes of the current legislation Personal Data Protection, Flamenco Campers & Vans, SL informs that your personal information provided for the execution of the contract and the information collected during the term of the rental services, will be incorporated into a file of personal data, duly registered in the Register of the Spanish Data Protection Agency, created under the responsibility of this company and based at Paseo de Sancha, 60 Malaga, in order to manage the services of car rental contracts, and for commercial purposes such as keeping you informed of all the offers, products and promotions that may be of your interest, either by email or another equivalent means.

In the case of commercial communications by e-mail or equivalent and in accordance with the provisions of Act 34/2002 regarding Information Society and Electronic Commerce Services, you expressly authorize the sending of advertising through this media. This authorization may be revoked at any time by request to the following address: customerservice(at)flamencocampers.com

Additionally, Flamenco Campers & Vans, SL informs you that, in the event of lack of payments related to rental services contracted by you, and upon the request of payment by Flamenco Campers, the information on such failure may be reported to credit information files, in accordance with the existing legislation on data protection.

You can exercise your right of access, rectification, cancellation and opposition by writing to the Customer Service Department or to the address above.

14.Travel insurance

We strongly recommend that clients ensure they take out the highest level of travel insurance. In many cases this will cover any losses incurred if you are forced to cancel your booking.

15. Restrictions

Flamenco Campers vehicles are restricted  from being driven in Africa.

16. Jurisdiction

In case of any claims arising from or related with any act regarding the reservation or lease of the van, it is hereby agreed that is the jurisdiction will be the Courts of Malaga (Spain).

In case of discrepancy between the Spanish and the English versions of this terms & conditions, the Spanish version shall always be applied.

FAQ's
In this section we collect the most frequently asked questions to help you with your doubts.

1. Where is Flamenco Campers?
We are in Malaga, just 10 minutes from the Pablo Picasso International Airport. If you want, we can meet you at the airport or train station AVE. (Service under request)

2. What does the rent price include?
The rental price includes VAT and full insurance with roadside assistance, plus everything you need, we hope. Our campers include a basic equipment. You can also rent many other accessories as extra equipment for you not to miss fun and comfort in your holidays.

3. How old do I have to be to rent a camper?
More than 28 years and driving license class B with at least 3 years old. If you're not European resident you will need the international license.

4.What documentation do I need to present to collect the camper?
You must present your ID card or passport, driving license, an updated invoice (2 months max.) of domestic supply (telephone, water, electricity, bank, etc ...) to confirm your address and a credit card to pay the security deposit. Without this documentation we cannot rent the camper and it will be considered as a last-minute cancellation.

5. Why do I have to pay a security deposit?
The security deposit of 600 € is charged on the credit card when collecting camper. It is a fully refundable deposit, which is used in the event of any damage or defect in the vehicle and its interior, tires, windows and basic & extra equipment, during the rental period. It is also applicable to the payment of eventual fines.

6. Can I add additional drivers?
You can if he meets all general requirements. Only 1 additional driver can be added at a cost of 50€ per rental.

7. Are there any restrictions on mileage?
Mileage is unlimited in rentals over 7 days. For rentals less than 7 days it is allowed a maximum of 200 km/day at a cost of 0.40 € + VAT per mile in excess.

8. What do I have to bring with me?
The campers are equipped for you to bring only your backpack with your luggage. You can even bring your sleeping bag or your linen and towels; otherwise you can rent them too, as well as pillows, quilts and many other extras.

9. How many people can travel and sleep in a camper?
Our campers are approved to travel 4.

10. Can I take my dog ​​with me?
We have a camper reserved for you to travel with your dog. Others are reserved to respect those with allergies. We accept only one dog per camper with an extra charge of 50 € for the total rent as an additional cleaning fee. You must never leave the dog alone in the camper. You must inform us in advance to confirm our approval and availability.

11. Can I smoke or light candles in the camper?
In order to be respectful to future clients, we do not allow smoking within our campers. For safety reasons, it is also forbidden lighting candles inside the camper.

12. Can I leave my car in your facilities?
Yes, we have an outdoor parking on our premises for you to leave your vehicle. This service is free but is always at your own risk.

13. Can I go out of Spain with the camper?
No, the insurance policy does not cover outside the country. To leave the country you need express written permission from FC to be requested at the time of booking and an international insurance at an extra charge.

14. Do I pay any additional cleaning costs to the amount of rent?
No, as long as you return the camper in the same clean condition that you collect it, so you should clean it after your vacation outside and inside, empty the waste water and sewage tank (only Exclusive). If not we will charge a penalty of 150 € + VAT.

15. What time can I pick up and return the camper at?
Generally the supply of vehicles shall be from Monday to Friday, from 14:00 to 19:00 PM; the returns are from Monday to Friday before 11:00 AM.
On Saturdays and Sundays deliveries and returns will only be accepted if an agreement is reached prior at an additional cost according to current rates.
If you need different hours of collection or delivery, please contact us. We will try to adjust ourselves to your needs always in agreement.

16. How fast you are traveling in the camper?
The maximum speed will depend on the road. You must respect the speed limits set by law at all times. In motorways we recommend you not to exceed the 110 km/h.

17. How high is the camper?
California Coach model is 2.00 m with the pop up roof closed and 2.70 m with the roof open. The California Exclusive model measures 2.70 m in height.

18. What fuel is used by campers?
Our campers are all diesel. (Never Biodiesel)

19. What do you do when there is a fault?
Our campers have full insurance and roadside assistance. The first thing to do is to inform Flamenco Campers for us to quickly handle your roadside assistance with the insurance company. You will find in your camper all the information about what to do in case of failure.
We recommend you to hire a travel insurance in the event of unforeseen circumstances that may affect your holiday.

20. Do you have radio/CD to connect my mp3?
All our campers are equipped with a radio/CD player with MP3 connection, you only must bring your wire connection.

21. Can I visit a camper before I rent it?
You can visit always visit us as long as you make an appointment. This way we will be able to attend you properly.

22. Can I install baby seats or child in the camper?
Yes, you can. If you do not want to bring yours we also have them available in our Extras section.

23. Do we have to put gas in the kitchen?
The gas for the kitchen is provided by FC. If you run off gas along the journey you will find replacement bottles at campsites and some petrol stations. This one is at your cost.

24. Are personal belongings covered by insurance?
No, renters insurance does not cover loss, damage or theft of your belongings. We recommend you to hire a travel insurance that covers your personal belongings.

25. Can we bring our bikes?
Yes you can. We can provide you with a bike rack at a cost according to the extras price list. We also have bikes for rent.

When you pick up your vehicle, you will be required to sign a rental agreement with the supplier of the vehicle. Your rental and use of the vehicle will be governed by the terms of the rental agreement and any other documentation or information provided to you by the supplier at the time you pick up your vehicle. The rental agreement is between you and the supplier and we will not be liable to you or to any third party in relation to the terms of the supplier’s rental agreement or any other documentation provided to you by the supplier at the time of pick up.

While we will make reasonable efforts to ensure we are representing only reputable suppliers, we make no warranty about the fitness or suitability of any third party (supplier) product or service and will not accept responsibility for the quality or fitness of any vehicle. We welcome feedback from our customers on their experience with our suppliers. We may, at our discretion, provide you with reasonable assistance in resolving any dispute you may have with a supplier.

Our total liability to you in relation to your use of this website and the information contained on this website will not exceed the dollar amount of the deposit we have received from you in relation to your booking/rental. Refunds will not be made for bookings cancelled due to inclement weather. Again, we strongly recommend that you take out travel insurance. Your use of this website is governed by the laws of New Zealand and the jurisdiction of the New Zealand courts.

Booking information
To make a booking you must complete our booking form which is easy to follow and secured with the latest encryption technology. Once we receive your form, we will, subject to availability, confirm your booking by emailing you a confirmation voucher and invoice. The deposit required to secure your vehicle (as shown on the secure booking page) will only be processed on your credit card when your booking is confirmed. Please note that a 1.75% credit card charge will be added when your payment is processed.

A booking is confirmed when you have been emailed a confirmation voucher and at this stage the deposit is processed on your card and becomes non-refundable and any cancellation fees stated in the supplier's terms apply. Upon receipt of your confirmation, please check your details carefully and notify us immediately if there are any incorrect details, as it may not be possible to make changes at a later date.

If you are booking via phone, please make sure you have read the terms and conditions of the vehicle you wish to rent first. Our reservations consultant will ask you if you have read the terms and agree to them before proceeding. The onus is always on the renter to ensure they make themselves fully aware of the terms displayed on our website.

Information disclosure
In booking on this website you acknowledge that we disclose your information to your selected Supplier in order to provide the requested rental services.

Amendments
Please note that some suppliers treat an amendment as a new booking and apply the rate current at the time the amendment is made to recalculate the entire booking amount (not just the days changed). If the rental period is increased, an additional deposit may be required. If the rental period is shortened which results in a reduction of the rental charges, the deposit amount will remain unchanged, and the difference between the original and revised deposit is forfeited (it cannot be used towards remaining rental charges). To request a change to a confirmed booking, please use the alterations request link on your confirmation. Any alterations are subject to availability and the approval of the supplier. In addition to the alteration policy of the supplier stated in their terms, the following charges will apply:
Motorhome rental alterations (all charges stated in local currency):
To change dates or times that result in a recalculation of rental rates, or to change vehicles or locations: 75.00
To add or remove extras to/from confirmed booking: 20.00
The alteration fee will not be charged if your alteration request is not possible.

Vehicle Capacity and fitness to drive
Under no circumstances are you permitted to carry more passengers than the vehicle you rent is legally registered to carry, and if you do your insurance may be invalidated. The number of seatbelts (and passengers) is indicated next to each vehicle on this website. Luggage capacity where shown is an indication only and we will not be responsible should you be unable to fit your entire luggage into a vehicle. It is your responsibility to choose a journey that is within your capabilities. A vehicle supplier can refuse to rent a vehicle to any person who is in their opinion unfit to drive or does not meet eligibility requirements. In such circumstances we will have no further liability to you.

Refund Policy
We are committed to providing a quality service and aim for complete customer satisfaction. In the event of cancellation, any refunds or penalties are detailed in the terms and conditions of your selected vehicle that you are asked to read and accept at time of booking. In the event you are unsatisfied with our service, please contact us within 48 hours of placing your booking or request and we will work to resolve any issues and determine if compensation is due. In the event you have completed your rental and are unhappy with your vehicle, we are happy to assist you in seeking compensation from the operator of the vehicle.
